The Site is operated by Larry S. Nichter, MD, of Pacific Center for Plastic Surgery ("we," "us," or "our"), located at 3991 MacArthur Blvd, Suite 320, Newport Beach, California 92660.

The Site is an educational resource about plastic and reconstructive surgery and the services Dr. Nichter offers. By using the Site, you agree to the practices described here.

Information we collect

Information you give us

We do not ask you for personal information simply to browse the Site. You may choose to provide information when you:

  • Submit our contact or consultation request form — typically your name, email address, phone number, the procedure or topic you are interested in, and any message you write.
  • Opt in to text messages by checking the SMS consent box on the form (see Text messages below).
  • Call or email us using the contact details published on the Site.

Please do not include detailed medical history, insurance details, or other sensitive personal information in the website form. It is intended for scheduling and general inquiries; we will discuss your medical information with you privately.

Information collected automatically

Like most websites, when you visit the Site our web server and analytics tools automatically record certain technical information, such as your IP address, browser and device type, operating system, the pages you view, the date and time of your visit, and the website that referred you. This information helps us keep the Site running, understand which pages are useful, and improve the experience. It is used in aggregate and is not combined with the information you submit through the form.

How we use your information

We use the information you provide to:

  • Respond to your inquiry and help you schedule a consultation;
  • Communicate with you about your appointment or the services you asked about;
  • Send occasional practice news, offers, or educational updates by email, if you have expressed interest — you may unsubscribe at any time using the link in any such email;
  • Send text messages, only if you have opted in;
  • Operate, protect, and improve the Site.

We do not sell, rent, or lease your personal information to anyone.

Contact form and patient relationship management

Our contact form is provided by AesthetixCRM, a patient relationship management service used by our practice. When you submit the form, the information you enter is transmitted to and stored on AesthetixCRM's secure servers so that our team can review it and follow up with you. The form is embedded from a domain associated with our practice (go.pacificcenterplasticsurgery.com). AesthetixCRM acts as a service provider on our behalf and is not permitted to use your information for its own purposes.

Text messages

If you check the SMS consent box on our contact form, you agree to receive text messages from Pacific Center for Plastic Surgery related to your inquiry, such as appointment scheduling, reminders, and follow-up. Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, and you can reply HELP for assistance or call us at (949) 832-7501.

Text-messaging consent is not a condition of receiving care or any service. Your mobile phone number and your SMS opt-in consent will not be shared with or sold to third parties or affiliates for marketing purposes.

Cookies and analytics

We use Google Analytics to understand, in aggregate, how visitors use the Site — for example, which pages are most popular and how people find us. Google Analytics uses cookies (small text files stored by your browser) and collects information such as your IP address, approximate location, device and browser details, and the pages you visit. We use Google Analytics for basic measurement only; we do not use it for advertising personalization or remarketing.

Google may process this data on servers in the United States and elsewhere. You can learn how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites, and you can prevent Google Analytics from collecting your data by installing the Google Analytics Opt-out Browser Add-on. Most browsers also let you refuse or delete cookies through their settings; the Site will still work if you do.

The Site does not currently respond to "Do Not Track" browser signals, because there is no common standard for how to interpret them.

Embedded content and third-party services

Some pages include content served by third parties, which may set their own cookies or collect your IP address when the content loads:

  • Video — videos are embedded from YouTube using its privacy-enhanced mode ("youtube-nocookie.com"), which does not store personally identifiable cookie information unless you play the video. YouTube is operated by Google; see Google's Privacy Policy.
  • Icons and page assets — some interface icons are loaded from a public content delivery network (unpkg.com), which receives your IP address in order to deliver the files.
  • Our media server — images and video hosted on media.drnichter.com are operated by us.

Our Site also links to other websites, including RealSelf, Yelp, YouTube, and professional organizations. We are not responsible for the content or privacy practices of those sites, and we encourage you to read their privacy statements.

How we share information

We share personal information only in these situations:

  • Service providers that help us operate the Site and the practice — such as AesthetixCRM (contact management), Google (analytics), and our web hosting provider. They may use your information only to perform services for us and must keep it confidential.
  • Legal requirements — if required by law, subpoena, or legal process, or when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
  • With your consent or at your direction.

Security and retention

We use reasonable administrative, technical, and physical safeguards to protect your information, and the Site is served over an encrypted (HTTPS) connection. No method of transmission over the Internet is completely secure, however, and we cannot guarantee absolute security. We keep inquiry information for as long as it is needed to respond to you and manage our relationship with you, or as required by law.

Your choices and rights

You may, at any time:

  • Ask what personal information we hold about you from your use of the Site;
  • Ask us to correct or delete it. On receipt of a verifiable request we will delete your personal information from our records and direct our service providers to do the same, unless we need to keep it to complete a service you requested, detect or prevent fraud or security incidents, comply with a legal obligation, or for another purpose permitted by law. Medical records are subject to separate retention requirements and our Notice of Privacy Practices;
  • Unsubscribe from marketing emails using the link in any email, or stop text messages by replying STOP.

Patients and health information

This Privacy Policy covers the drnichter.com website. Once you become a patient of Pacific Center for Plastic Surgery, your medical information is protected under the Health Insurance Portability and Accountability Act (HIPAA) and California law, and is governed by our Notice of Privacy Practices (PDF), which explains how medical information about you may be used and disclosed and how you can get access to it. Before-and-after photographs shown on the Site are published with the written consent of the patients pictured.

Children

The Site is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, please contact us and we will delete it.

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the effective date below and, for significant changes, post a notice on the Site. Your continued use of the Site after changes are posted means you accept the updated policy.
